Statutory Framework

The Rules That Govern Every Knock

Most attorneys know service of process is required. Fewer know exactly which statute applies when the front door stays shut for three straight mornings.

Documents must be delivered directly into the hands of the named respondent. Our agents confirm identity before tendering — a step most skip tracers skip, causing service to be challenged months later.

After two failed personal attempts at different times of day, we may serve a competent adult at the dwelling and mail a copy first-class. Courts require the mailing to occur within one business day of physical tender.

Permitted only when the respondent acknowledges receipt in writing. We prepare the notice-and-acknowledgment form and track its return. Without the signed acknowledgment, service is not complete.

When a defendant cannot be found after exhaustive due diligence, the court may authorize publication in an adjudicated newspaper. We prepare the affidavit of due diligence required to obtain that order.
